Terms and Conditions
Effective Date: June 3, 2025
These Terms and Conditions (“Terms”) govern your access to and use of Look@’s websites, applications, hardware, and related products and services (collectively, the “Look@ Products and Services”).
By using the Look@ Services, you confirm that you have read, understood, and agreed to these Terms and all related policies, including our Privacy Policy. If you do not agree, do not use the Services.
1. Your Content and Permissions
You retain ownership of all content you upload or share through Look@.
To operate and promote the Look@ Services, you grant Look@ a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, host, store, reproduce, display, and distribute your content in connection with the Look@ Services.
This license ends when you delete your content or account, unless the content has been shared with others who have not deleted it. Deleted content may remain in backup systems for a reasonable period.
Applications that interact with your content must obtain appropriate permissions. If you choose to make content public, you understand that it may be accessible to anyone and associated with your profile.
Any feedback or suggestions you provide may be used by Look@ without compensation.
2. Safety and Acceptable Use
We work to keep Look@ safe, but we cannot guarantee it.
You agree not to:
- Post spam or unauthorized commercial content
- Use automated tools (bots, scrapers) without permission
- Upload viruses, malware, or harmful code
- Harass, bully, threaten, or intimidate others
- Post hate speech, nudity, or violent content
- Engage in unlawful, misleading, or discriminatory behavior
- Interfere with or disrupt the Services
- Encourage or assist others in violating these Terms
3. Accounts and Security
You agree to:
- Use your real identity and not create accounts for others without consent
- Not use the Services if you are under applicable age of consent in your jurisdiction (13–16 depending on country) or a convicted sex offender
- Keep your contact information accurate and up to date
- Keep your login credentials confidential
- Not transfer your account without written permission
- Use a Look@ Page (not a personal account) for commercial purposes
We may reclaim usernames if necessary.
4. Respecting the Rights of Others
You agree not to post content that violates applicable laws or the rights of others, including intellectual property and privacy rights.
If your content includes images of other people, you represent and warrant that you have obtained all necessary permissions and consents from those individuals.
Repeated infringement or violations may result in account suspension or termination.
5. Mobile Devices and Connectivity
Look@ mobile services are provided free of charge, but your carrier’s standard charges may apply.
If you change or deactivate your phone number, you must update your account within 48 hours. You consent to others syncing their devices with content you have made visible to them.
6. Payments
If you make a purchase through Look@, you agree to any applicable payment terms or supplemental conditions presented at the time of purchase.
7. Developers and Platform Use
If you develop apps or use our Platform (e.g., APIs), you must follow our rules, protect user data, and not collect or distribute data unlawfully. Contact us to establish agreements.
8. Email Communication
We collect your email address to deliver your photo and provide essential service-related communications.
9. Data Storage and Protection
We store photos and email addresses securely on encrypted servers (such as Microsoft Azure) and comply with applicable data protection laws, including GDPR.
Users may request the removal of their photo or personal data.
10. User Conduct and Responsibility
You agree to use the Services lawfully and respectfully. If you capture others in photos, you must obtain their consent.
Look@ does not control or endorse user-generated content and is not responsible for the accuracy, legality, or appropriateness of content posted by users. You accept full responsibility for any disputes or claims arising from your content.
11. Physical Interaction Disclaimer
Use of Look@ physical installations and selfie sculptures is at your own risk.
Look@ is not responsible for:
- Injuries sustained while interacting with installations
- Conflicts occurring in queues or public spaces
- Damage or harm caused by tampering with or misusing equipment
12. Intellectual Property and Enforcement
We may remove content that infringes others’ rights.
We reserve the right, but are not obligated, to remove or restrict access to content or accounts that violate these Terms or applicable law, without prior notice. Repeated or serious violations may result in suspension or permanent termination of access to the Services.
You may not use Look@ trademarks or branding without prior permission.
13. Advertising and Promotional Use
You grant Look@ a non-exclusive, royalty-free right to use your name, profile image, and content in connection with the commercial, sponsored, or promotional promotion of the Look@ Services, subject to your selected visibility settings and applicable law.
We do not share your personal information with advertisers without your consent.
14. Software and Updates
If you use Look@ software, we may automatically install updates to improve performance, security, or functionality.
You may not reverse-engineer, modify, or extract source code unless permitted by law or authorized in writing.
15. Disputes and Limitation of Liability
These Terms are governed by the laws of the Republic of Croatia. Any disputes must be resolved exclusively by Croatian courts.
You agree to indemnify Look@ against claims arising from your actions or content.
Look@ is not liable for indirect or unforeseeable damages, third-party content or behavior, or failures due to events beyond our control.
Our total liability is limited to €100 or the amount you paid to Look@ in the previous 12 months, whichever is greater.
16. Users Outside Croatia
By using Look@, you consent to the processing of your personal data in Croatia. You may not use the Services where prohibited by law.
17. Definitions
- Look@ Services: Look@ websites, apps, hardware, APIs, and related services
- Platform: Tools and APIs enabling third-party integrations
- Content: Photos, media, or data you upload or share
- Data: Information related to users and usage
- Post: Making content available through Look@
- Trademarks: Look@ branding and registered marks
18. Termination
We may suspend or terminate your access if you violate these Terms or applicable law.
If your account is terminated, these Terms end except for provisions that by nature should survive, including Sections 10–18.
19. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you. Continued use of the Services after changes take effect constitutes acceptance.
20. Disclaimer
The Look@ Services are provided as-is. We do not guarantee uninterrupted or error-free operation. Use the Services at your own risk.
If you are a California resident, you waive Civil Code §1542. We are not liable for any misuse, misconduct, or third-party harm arising from the use of Look@ Selfie Sculptures.
